1. About Godasya

Godasya is a food brand that sources, private-labels, and markets traditional cow ghee products in Maharashtra, India. Our products are manufactured by a third-party food manufacturer to quality specifications set by us. Godasya is the brand owner and seller — not the manufacturer.

We operate in compliance with applicable food safety laws under the Food Safety and Standards Act, 2006 (FSSA) and the regulations of the Food Safety and Standards Authority of India (FSSAI). We have submitted an application for FSSAI registration/licence and will update our food safety disclosures upon grant.

2. Products & Descriptions

We offer the following products:

Product images on our website and marketing materials are for illustrative purposes. Actual colour, texture, and aroma of ghee may vary slightly between batches due to its natural, additive-free composition — this is normal and does not constitute a product defect.

3. Ordering & Contract Formation

• Orders are currently accepted via WhatsApp. A binding purchase contract is formed when we send you an order confirmation message and receive payment.
• We reserve the right to refuse or cancel any order at our sole discretion — for example, if a product is out of stock, payment is not received, or we identify an error in pricing.
• Prices displayed on our website are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• We reserve the right to change prices at any time. Price changes will not affect orders already confirmed by us.

4. Shipping & Delivery

• We currently ship within India. Estimated delivery times are 5–7 business days from dispatch and are provided as a guide only — delays due to courier partners, weather, strikes, or other factors beyond our control do not entitle a customer to compensation.
• Free shipping applies to orders of 2 or more jars. Single-jar shipping charges will be communicated at the time of ordering.
• Risk of loss and title for products pass to you upon delivery to the shipping address provided. Please inspect your order upon receipt and report any damage or shortage within 48 hours of delivery.
• We are not responsible for failed deliveries caused by inaccurate or incomplete addresses provided by you.

5. Storage, Usage & Safe Consumption

• Storage: Store in a cool, dry place away from direct sunlight. Keep the jar tightly sealed after use. Do not refrigerate unless temperatures exceed 30°C consistently. Ideal storage temperature is 10°C–25°C.
• Moisture contamination: Always use a clean, dry spoon. Never introduce water or wet utensils into the jar. Moisture is the primary cause of rancidity in pure ghee.
• Shelf life: Best consumed within 12 months of manufacture when stored correctly. The manufacture and best-before dates are printed on the jar lid. Do not consume after the best-before date.
• Signs of spoilage: Discard the product if you notice an unusual sour smell, discolouration, or visible mould. Do not taste-test suspected spoiled ghee.
• Cross-contamination: Keep away from strong-smelling foods and chemicals. Ghee is porous to odours.
• Children: Ghee is generally safe for children over 6 months of age when introduced appropriately. Consult your paediatrician before introducing ghee to infants.

Godasya does not make any therapeutic, curative, or disease-prevention claims about our products. Any general information on our website about the nutritional or traditional benefits of ghee is provided for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

• If you have a medical condition including but not limited to cardiovascular disease, diabetes, high cholesterol, or a digestive disorder, consult your physician or registered dietitian before consuming ghee.
• Pregnant or breastfeeding individuals should consult their healthcare provider before making dietary changes.
• Our products are food products and are not medicines, supplements, or health devices regulated by any drug authority.
• Individual results from consuming our products may vary based on age, diet, health status, and other individual factors.

8. Subscriptions & Bulk Orders

Subscriptions: Subscription plans are prepaid for 3, 6, or 9 months. One jar is dispatched each month. To modify or cancel, contact us on WhatsApp before the next dispatch date. If a subscription is cancelled midway, all subscription discounts will be reversed and deducted from the final refund amount. The net refund will be calculated based on the single-jar MRP for jars already dispatched.

Bulk / Prepaid Orders: Bulk orders of 3 or more jars in a single order qualify for a 5% or more prepaid discount. Bulk orders are dispatched together as a single shipment. Cancellation of a bulk order after payment but before dispatch is subject to our Refund Policy. Once dispatched, bulk orders cannot be cancelled.

9. Limitation of Liability

• To the maximum extent permitted by applicable Indian law, our total liability for any claim arising from or related to a product purchase shall not exceed the purchase price paid by you for the product in question.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of income, loss of profits, or any health consequences arising from:
  • Failure to follow the storage and usage instructions in Clause 5
  • Consumption of the product after its best-before date
  • Consumption by an individual with a known dairy allergy or sensitivity (see Clause 6)
  • Combination of our product with other foods, medications, or supplements
  • Any pre-existing health condition not disclosed to us at the time of ordering
  • Adulteration or tampering with the product after delivery
• Our products are sourced from a manufacturer who is responsible for maintaining FSSAI compliance and good manufacturing practices at their facility. Godasya, as brand owner and seller, undertakes quality oversight at the time of procurement. Our liability for a product found to be genuinely defective at the time of manufacture will be addressed under our Refund Policy and in accordance with the Consumer Protection Act, 2019.
• Godasya does not own or operate a food manufacturing facility. In the event of a claim arising from a manufacturing defect, Godasya will, where possible, facilitate resolution with the manufacturer; however, Godasya's liability to you as a customer shall remain limited as set out in this section. Details of our manufacturer are available on our product labels as required under FSSAI Labelling Regulations.
• Nothing in these Terms seeks to exclude or limit any liability that cannot be excluded under applicable Indian law, including the Food Safety and Standards Act, 2006, the Consumer Protection Act, 2019, or any other statutory rights you may have as a consumer.

10. Statutory Consumer Rights

As a consumer in India, you have rights under the Consumer Protection Act, 2019 and the Food Safety and Standards Act, 2006 that cannot be waived by contract. These include the right to seek redress for defective goods, unfair trade practices, and unsafe food. Nothing in these Terms is intended to override, restrict, or diminish those statutory rights. If a provision of these Terms conflicts with your statutory rights, your statutory rights shall prevail.

11. Intellectual Property

All content on our website and marketing materials — including the Godasya name, logo, product names, photographs, descriptions, and text — is the intellectual property of Godasya or its licensors and is protected under applicable Indian intellectual property laws. You may not reproduce, distribute, or use any of this content without our prior written consent.

The word mark GODASYA™ is the subject of a trademark application filed in India under the Trade Marks Act, 1999. Unauthorised use, imitation, or passing off of the GODASYA name or mark — whether in commerce, on digital platforms, or otherwise — constitutes trademark infringement and may attract civil and criminal liability under Indian law. Godasya reserves the right to take all available legal action to protect its intellectual property rights.

12. Privacy

Your personal data shared with us when placing an order (name, phone number, delivery address) is collected and processed in accordance with our Privacy Policy, which forms part of these Terms. By placing an order, you consent to the use of your personal data as described therein.

13. Refunds & Returns

All refunds and returns are governed by our Refund Policy, which forms part of these Terms. Please review it before placing an order.

14. Indemnification

You agree to indemnify, defend, and hold harmless Godasya and its owners, employees, and agents from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of: (a) your violation of these Terms; (b) your misuse of the product contrary to storage or usage instructions; (c) any false or inaccurate information you provided to us in connection with an order; or (d) your violation of any applicable law or third-party right.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any dispute arising from or relating to these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

Before initiating legal proceedings, we encourage you to contact us on WhatsApp or at godasya.products@gmail.com so we can attempt to resolve the matter amicably within 15 business days. Consumer complaints may also be filed with the District Consumer Disputes Redressal Commission having jurisdiction over your district.

16. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms. For significant changes, we will endeavour to notify regular customers via WhatsApp.

17. Force Majeure

Godasya shall not be liable for any failure or delay in performing its obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, floods, fire, earthquakes, epidemics or pandemics, government orders or regulations, war, civil unrest, nationwide or regional strikes, power outages, internet or telecommunications failures, supply chain disruptions, or failure of third-party courier or logistics partners.

In such events, our obligations will be suspended for the duration of the force majeure event. We will notify affected customers via WhatsApp as soon as reasonably practicable and will endeavour to fulfil or reschedule orders at the earliest opportunity.

18. WhatsApp as Valid Communication

Since orders are currently accepted via WhatsApp, all communications between you and Godasya conducted over WhatsApp — including order placements, order confirmations, payment acknowledgements, cancellation requests, and any notices — shall constitute valid written communications for the purposes of these Terms and applicable Indian law. You agree that WhatsApp message records may be relied upon as evidence of the agreement between the parties.

19. Personal Use & No Resale

Products purchased from Godasya are intended for personal and household consumption only. You may not resell, redistribute, or commercially exploit any product purchased from us without our prior written consent. We reserve the right to refuse or cancel orders that we reasonably believe are placed for unauthorised commercial resale.

20. GST & Tax Invoices

GST invoices will be issued where applicable and as required under the Goods and Services Tax Act. If you require a GST invoice for business purposes, please notify us at the time of placing your order and provide your GSTIN. We are not obligated to issue or amend invoices after an order has been confirmed and dispatched.

21. Product Recall

In the unlikely event of a product safety concern necessitating a recall — whether initiated by Godasya, our manufacturer, or directed by FSSAI — we will notify all potentially affected customers via WhatsApp and/or email as promptly as possible. We will arrange for collection, replacement, or refund of the affected product at no cost to you. You agree to cooperate with any recall process and to cease consumption of the affected product immediately upon notification.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect and shall not be affected by such invalidity or unenforceability.

23. Entire Agreement

These Terms, together with our Refund Policy and Privacy Policy (each of which is incorporated herein by reference), constitute the entire agreement between you and Godasya with respect to your purchase and use of our products. These Terms supersede all prior discussions, representations, understandings, or agreements — whether oral or written — between you and Godasya relating to the same subject matter.

24. No Waiver

Our failure or delay in exercising any right, power, or remedy under these Terms on any occasion shall not constitute a waiver of that right, power, or remedy, nor shall it prevent us from exercising it at any future time. No single or partial exercise of any right or remedy shall preclude any other or further exercise thereof. Any waiver must be made expressly and in writing to be effective.

25. No Agency or Partnership

Nothing in these Terms creates, or shall be deemed to create, any agency, partnership, joint venture, employment, or franchise relationship between Godasya and the customer. You have no authority to bind Godasya in any way, and you may not represent yourself as a representative, agent, or partner of Godasya.
